NOTE - Client's accounts will be cancelled and client may be subjected to monetary penalties (fines) if we receive any complaints of violation of our Anti-Spam Policy.
1) Sender must use a valid return email address so that people can reply to your emails without receiving a bounced message. This return email address must be one which is attended to in such a way that a person reads and responds to all emails received. It cannot be an unattended and/or automated response address.
2) Sender's real name, real company name, real phone number, real address, real email address, and real website address must be contained in the body of the message. This information must be valid such that recipients may contact sender directly and receive a personal (not automated) response.
3) Sender must provide the recipient with a valid method of removal from your list. The recipient must be able to easily request removal and receive no additional correspondence from you other than at most one email to confirm their removal.
4) The recipient's email address must have been obtained by sender or sender's company personally from the recipient or by direct request of the recipient. Sender may not use lists falsely claiming to be Opt-in (recipient requested) lists. It is the SENDER'S responsibility to confirm the authenticity of the lists.
5) Sender may not disguise the address to which the email has been sent or from which the email has been sent so as to attempt to bypass anti-spam software or to deceive the recipient in any way. Sender may not leave the return address blank nor put the recipient's address as the sender, nor use any other method of subterfuge.
6) Complete Agreement; Severability. This Agreement supersedes any other written or oral agreement, and represents the complete understanding between Provider and Customer. If any provision of this agreement is held by a court of competent jurisdiction to be contrary to law, the remaining provisions of this agreement will remain in full force and effect. This online agreement may be signed, but does NOT have to be signed to be enforced.
NOTE - Differing laws may exist about what is considered spam or unsolicited (commercial) email. Our Anti-Spam Policy may change at any time just as laws may change. Even if sender adheres to our Anti-Spam Policy sender may still be in violation of national, federal, state or local laws. It is the SENDER'S responsibility to be in compliance with such requirements.
Creative Computer Consulting, LLC reserves the right to determine what constitutes spam (email abuse). Clients who are determined to be abusing their account(s) will be terminated. If a client has been determined to be using our servers (or connections) to distribute unsolicited emails Creative Computer Consulting, LLC reserves the right to charge $1.00 per spam message that is sent (minimum $250.00). Creative Computer Consulting, LLC will work in full cooperation with authorities to track down clients who are suspected of abuse. No refunds will be given to clients whose accounts have been terminated regardless of the reason for the termination.
